Neste Oil continues fight against Greenpeace site, in spite of promises

Stockholm 2012-07-02: Neste Oil Corporation is pursuing efforts to close Greenpeace site Nestespoilreturns.com in an amended complaint through the World Intellectual Property Organization (Wipo). This is done in spite of reassurances to the media that the site would be left alone as it no longer carried any risk of a mix-up with Neste sites. Nestespoiledreturns.com is a parody site hosted by Binero and protesting the environmental effects of the oil company’s production of palm oil diesel. Its predecessor, nestespoil.com was shut down as a result of Neste claims of copyright infringement against the former web host. Wipo-ruling is expected 26th of July.

- We feel it important to expose how this big oil company is continuing its efforts to shut down our client Greenpeace’s site, in spite of their media statement to the contrary. Nestespoilreturns.com may yet become an example of the limits of political parody on the net, said Erik Arnberg, Marketing Manager at Binero, the web host currently hosting Nestespoilreturns.com.

Initially, Greenpeace published the site Nestespoil.com as a parody against the state-owned oil corporations large diesel oil production. Neste got the site shut down after a copyright law suit not against Greenpeace but against the former web host. Following this, Greenpeace set up the site Nestespoilreturns.com with Swedish host Binero. Later, Greenpeace also altered the content, placing a big red banner on top, limiting the amount of previous content shown and clearly indicating it to be a parody site.

On the 13th of June, Neste Oil General Counsel Matti Hautakangas told Finnish magazine IT-Viikko/Digitoday that Neste did not demand the closure of the Greenpeace site as long as it was evident that the site did not originate from Neste Oil. He further specified that the current (Nestespoilreturns.com) version of the page clearly showed that it did not come from Neste. On the 16th in an e-mail to Swedish Radio program Medierna he further stated that no action would be taken against the current site at the new web host.

And yet it has come to Binero’s attention that Neste Oil is pursuing an amended complaint filed against the new site domain Nestespoilreturns.com through the World Intellectual Property Organization (Wipo). The complaint was added to the earlier case D2012-0891 filed against the original domain nestespoil.com-site, and the Wipo Arbitration Panel will decide on July 26th.
